These Terms of Service ("Terms") govern your access to and use of westcoastcountryboy.com and any related online store (the "Site") operated by Chelon, LLC, doing business as West Coast Country Boy ("West Coast Country Boy," "we," "us," or "our"), and your purchase of products from us.
By accessing or using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority in your state of residence, to make a purchase or create an account on the Site. By using the Site, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete.
2. Accounts
You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you suspect any unauthorized use. We may suspend or terminate your account at our discretion if we believe you have violated these Terms.
3. Products, Pricing, and Availability
We make reasonable efforts to display our products and their colors, sizes, and other details accurately, but we do not guarantee that your device's display will be accurate. Product availability is not guaranteed, and we reserve the right to limit quantities, discontinue products, and refuse or cancel orders at any time.
All prices are listed in U.S. dollars and are subject to change without notice. We make reasonable efforts to ensure prices are accurate, but errors may occur. If we discover a pricing or product description error after you have placed an order, we may cancel the order and refund any amount charged, even if the order has been confirmed and your payment method charged.
4. Orders and Payment
When you place an order, you are making an offer to purchase the products in your cart subject to these Terms. Your order is not accepted until we send you an order confirmation or ship the product. We reserve the right to refuse or cancel any order, including for suspected fraud, product unavailability, errors in pricing or product information, or violation of these Terms.
You agree to provide current, complete, and accurate purchase and account information for all orders. You authorize us and our payment processors to charge your payment method for the total amount of your order, including any applicable taxes and shipping charges. Sales tax will be applied where required by law.
5. Shipping and Delivery
We currently ship within the United States only. Shipping times and costs are estimates and may vary based on the carrier, your location, and other factors. Risk of loss and title for products pass to you upon delivery to the carrier. We are not responsible for delays caused by carriers, weather, customs, or other circumstances outside our control.
6. Returns and Exchanges
Our returns and exchanges policy is published separately on the Site and is incorporated into these Terms by reference. Please review that policy before making a purchase.
7. Intellectual Property
The Site and all content on it, including text, graphics, logos, images, photographs, product designs, audio, video, and software, are owned by or licensed to West Coast Country Boy and are protected by copyright, trademark, and other intellectual property laws. "West Coast Country Boy" and the WCCB logo are trademarks of Chelon, LLC.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, publicly display, create derivative works of, or otherwise exploit any part of the Site without our prior written consent.
8. User Content
If you submit reviews, comments, photos, suggestions, or other content to the Site or to our social media accounts ("User Content"), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, distribute, and display the User Content in any media. You represent and warrant that you own or have the rights to the User Content you submit and that it does not violate any third-party rights or applicable laws.
We may, but are not obligated to, monitor, edit, or remove User Content at our discretion.
9. Prohibited Conduct
When using the Site, you agree not to:

- Infringe the intellectual property or other rights of any third party
- Submit false, misleading, or fraudulent information

THE SITE AND ALL PRODUCTS, SERVICES, AND CONTENT MADE AVAILABLE THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL CHELON, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCTS PURCHASED THROUGH THE SITE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless Chelon, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site, your User Content, your violation of these Terms, or your violation of any rights of a third party.
14. Governing Law and Venue
These Terms and any dispute arising out of or related to them or the Site are governed by the laws of the State of Washington, without regard to its conflict of laws principles. You and West Coast Country Boy agree to submit to the exclusive personal jurisdiction and venue of the state and federal courts located in King County, Washington, for any dispute not subject to arbitration or small claims court.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
16. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including for any violation of these Terms. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property rights, disclaimers, limitations of liability, indemnification, and governing law.
17. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy and any other policies posted on the Site, constitute the entire agreement between you and West Coast Country Boy regarding your use of the Site.
